PEM Convention: Impact of the New EU–Tunisia Origin Rules

A major regulatory change concerning the Pan-Euro-Mediterranean (PEM) Convention is likely to impact imports of goods released for consumption in Tunisia from the European Union.
These changes relate to preferential rules of origin, and more specifically to diagonal cumulation mechanisms.
Reminder: the PEM cumulation principle
The PEM Convention allows signatory countries to cumulate the origin of components in order to benefit from preferential tariff treatment in trade.
Until now, inputs of Turkish origin could, under certain conditions, be incorporated into a finished product manufactured in the EU while still retaining duty exemption upon import into Tunisia.
What changes under the revised rules
With the entry into force of the modernized rules:
- Cumulation involving Turkey is no longer automatically applicable
- As Turkey has not yet ratified the new provisions, the use of Turkish-origin inputs may jeopardize the preferential origin status of the finished product
- As a result, certain products may lose eligibility for preferential treatment when imported into Tunisia
This situation creates a degree of regulatory uncertainty for economic operators.

The Tunisian Customs Authority is expected to publish a forthcoming joint notice specifying:
- Applicable declaration procedures
- Required supporting documentation
- Potential transitional measures
In the meantime, increased vigilance is recommended regarding:

- Tariff classification and sufficient processing analysis
